Terms & Conditions for ProductBird

By signing up for or using Selektable VOF’s services (the “Service”), you agree to these Terms & Conditions (“Terms”). If you do not agree, please do not use or access our Service.

1. Accounts & Credits

1.1 Account Registration

You must create an account to access our API and dashboard.
You are responsible for safeguarding your password and any API keys issued to you.
You may not share your credentials or API keys with any third party.

1.2 Credit System & Usage

Our API is metered via virtual “credits.” Each API call deducts a set number of credits.
Upon sign-up, you receive a one-time allocation of free credits. No payment or credit-card details are required to register.
Additional credit packages may be purchased via our online portal; credits do not expire but are non-refundable once spent.

2. Purchases & Refunds

2.1 Purchasing Credits

You may purchase credit bundles at the prices listed on our website. All purchases are final once credits have been applied to your account.

2.2 Refund Policy

If you purchase credits and have not yet spent any of them, you may request a refund within 14 days of purchase by emailing support@productbird.ai. After any credit has been used, no refunds are available.

2.3 Suspension & Termination

We may suspend or terminate your access if you breach these Terms, engage in abusive or fraudulent API usage (e.g. scraping, denial-of-service attacks), or otherwise violate our Acceptable Use Policy.

3. Acceptable Use

You agree not to, and will not permit any third party to:

Reverse-engineer, decompile, or disassemble the Service.
Share, resell, or redistribute your API keys.
Use the Service to store or transmit infringing, libelous, or harmful content.
Attempt to circumvent our credit-metering, rate limits, or security measures.

4. Intellectual Property

All software, documentation, trademarks, and content provided through the Service (“ProductBird IP”) remain our exclusive property or that of our licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to use the ProductBird IP solely to access and use the Service in accordance with these Terms. You retain all rights in any data or content you submit to the Service (“Your Data”).

5. Service Levels & Updates

No Uptime Guarantee: The Service is provided “as is” without any warranty of availability or performance.
Maintenance & Deprecation: We may update, modify, or discontinue features at any time. We’ll notify you of planned deprecations or maintenance windows via the email address on your account.

6. Disclaimers & Limitation of Liability

6.1 No Warranty

The Service is offered “as is.” We expressly disclaim all warranties, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. AI-generated outputs may be incorrect or unreliable; you use them at your own risk.

6.2 Limitation of Liability

To the fullest extent permitted by law, in no event will Selektable VOF (or its officers, employees, or agents) be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the Service. Our total aggregate liability for all claims related to the Service will not exceed the amount you paid for credits in the 12 months preceding the claim.

7. Indemnification

You agree to indemnify, defend, and hold harmless Selektable VOF and its officers, directors, employees, and agents from and against any and all claims, liabilities, losses, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

Your use of the Service in violation of these Terms;
Your violation of any law or rights of a third party;
Any content you submit or transmit through the Service.

8. Governing Law & Disputes

These Terms and any dispute arising out of or related hereto will be governed by and construed in accordance with the laws of The Netherlands, without regard to conflict-of-law provisions. Any legal action or proceeding related to these Terms shall be brought exclusively in the competent courts of Amsterdam, The Netherlands.

9. Changes to Terms

We may revise these Terms at any time. We will notify you of material changes by email to the address on your account. Continued use of the Service after notice constitutes acceptance of the updated Terms.

10. Age & Compliance

You must be at least 18 years old to use our Service. By registering, you represent and warrant that you meet this age requirement.
You agree to comply with all applicable export control laws, anti-spam regulations, and other relevant laws.
